Terms of use

MEDIATION-HELP.COM website was created and is being maintained with the financial support of the European Union within the framework of the Project “CONSENT”, which is now being implemented by the PU “Ukrainian Academy of Mediation”. Its content is the exclusive property of the PU “Ukrainian Academy of Mediation” and does not reflect the views of the European Union. 

Public Union “Ukrainian Academy of Mediation” registered at 17, Hretska Street, Odesa, 65026, Ukraine. The e-mail address for feedback and questions related to these Terms of Use of the MEDIATION-HELP.COM website (hereinafter – the Terms): mediationhelp.com@gmail.com. Intellectual property rights to the MEDIATION-HELP.COM website belong to the PU “Ukrainian Mediation Academy”.

  1. General terms

1.1. These Terms set forth the adhesion agreement between the Website administration (hereinafter – Administration) and the Users of the website. 

1.2. By using this Site, you agree to be bound by these Terms. 

1.3. In these Terms, the words are used with the following meanings:

Site – web-platform MEDIATION-HELP.com owned by UAM.

Administration – employees of the Site management, who are authorized to create content for the Site and fill it, to collect, process, and store personal data of Site Users.

Site content – information, such as texts, databases, audio-visual, photographic, and graphic works, maps, computer programmes, massages, and other materials posted on the Site.

User – any natural person who is on the Site and uses the Site`s resources. 

Mediator-Site User – a natural person, who meets the conditions of the Law of Ukraine “On mediation” and submitted information about himself/herself for inclusion in the Site List of mediators. 

Site Partners – a national or foreign mediation organisation providing information or other support to the Site. 

Site List of Mediators – a set of information about mediators, which is formed on the basis of information provided by mediators about themselves and the services they agree to provide using the Site’s resources.

“Cookie” – a small text file, which the Site sends to the Users to facilitate their next visit to the Site. Cookies do not contain any personal data. Rejection of cookies by the User may prevent the use of certain functions of the Site. 

1.4. These Terms may be changed and complemented by Administration at any time. Updated Terms will be immediately posted on the Site.  

  1. Site content

2.1. Site content is filled by the Administration. Information for the Content is provided by Users, Mediators Site Users, and Site Partners in written form.  

2.2. Entering information on mediation and mediator organizations in different countries is carried out by filling in the appropriate Google Form by the Site Partners. A Google Form is sent upon request.

2.3. Database “List of mediators” is made by Ukrainian-speaking mediators by filling out the appropriate online form directly on the Site. The Mediator-Site User is responsible for the content and reliability of the information posted by him/her.

2.4. To enter information about himself/herself, the Mediator-Site User personally fills our the online registration form on the “Mediators” page (“Join the List of mediators).

2.5. The Administration approves the filled out online registration with the aim to:

  1. verify the compliance of the submitted information with the purpose of creating and functioning of the Site;
  2. verify the compliance of the information about the Mediator-Site User with the conditions prescribed by the Art. 10 and par. 2 of the Final and transitional provisions of the Law of Ukraine “On mediation”;
  3. prevent placing on the Site information with misprints or information that contradicts public order, the principles of humanity and morality.

2.6. The Administration does not modify or complement the online registration form filled out by the Mediator-Site User by its own discretion. If there is a need to modify the content of the online registration form, the Administration notifies Mediator of such a need and modify the online registration form at the request of Mediator-Site User in correspondence with the procedure prescribed in the par. 3.6. of these Terms. 

2.7. Approval of the filled out online registration form by the Administration or an appeal to the Mediator-Site User with a request to modify information is carried out within 5 days from the moment of submission of the online registration form.

2.8. The Site content is subject to the copyright in accordance with the legislation of Ukraine and international copyright law.

2.9. The Site content is intended for non-commercial use only.  

2.10. The Site content cannot contain information that contradicts public order, principles of humanity, and morality. 

  1. Rights and duties of Users

3.1. The User has the right to download or copy the Site Content in whole or in part for personal use only. 

3.2. The User has the right to use the Site`s resources to find a mediator and establish contact with him/her. 

3.3. The User has the right to manage cookies at the browser level by either accepting or rejecting them.  

3.4. The User has the right to contact the Administration with a statement, proposal, or request regarding the Site content or actions of the Administration relevant to the purpose of the Site, in writing at the address mediationhelp.com@gmail.com.

3.5. The Mediator-Site User has the right to update the information about himself/herself and the services he/she provides. In order to do this, the Mediator-Site User should fill out the new online registration form of the Site and notify the Administration in writing about the need to delete the previous data, or shoudl notify the Administration about the need to change the certain parts of information about the Mediator-Site User in the “List of mediators”. The corresponding notification should be send at the address mediationhelp.com@gmail.com.   

3.6. The Mediator-Site User has the right to contact the Administration with a request for temporary removal of the information about him/her from the public access with the preserving this information on the Site.

3.7. The User should be acknowledged with the Terms and comply with them, without violating the laws and affecting the rights of other users of the Site.

3.8. When providing information or contacting the Administration, the User should use true information about himself.

  1. Rights and duties of Administration

4.1. The Administration has the right to collect and post on the Site information, which corresponds to the purpose of the Site.  

4.2. The Administration has the right to edit, change, or delete the information provided for posting on the Site at its own discretion. 

4.3. The Administration should consider and respond to the User`s request within 5 days from the date of receipt of the request.

4.4. The Administration has the right to delete information about Mediator-Site User from the public access at the request of the organization of which the Mediator is a member, or which is defined as the place of training of the Mediator, or by a court decision.

The Administration should delete information about the Mediator-Site User from the List of mediators at his/her request for the period determined by the Mediator-Site User. 

4.5. The Administration should ensure uninterrupted work of the Site, however, cannot guarantee the complete absence of technical problems in the process of using the Site`s resources. 

  1. Liability and dispute resolution

5.1. The Administration is not liable for negative consequences and damages that may arise from using the Site’s resources.

5.2. The Administration is not liable for the content and accuracy of the information provided for posting on the Site. 

5.3. The Administration is not liable for the actions of mediators included in the List of mediators. 

5.4. Disputes between Users and the Administration will be resolved through negotiations or mediation. 

5.5. In case of impossibility to resolve the dispute through negotiations or mediation, the dispute will be resolved in accordance with the procedure defined by civil procedural law.
